12. No Reliance
You agree not to rely solely on Deskscale for financial, investment, trading, tax, legal, or accounting decisions. You are responsible for independently verifying information and consulting qualified professionals where appropriate.
13. Disclaimers
Deskscale is provided on an "as is" and "as available" basis. We disclaim all warranties to the maximum extent permitted by law, including warranties of accuracy, availability, completeness, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Deskscale Labs and its owners, directors, officers, employees, contractors, affiliates, partners, licensors, service providers, and agents will not be liable for any losses or damages arising from or related to your use of Deskscale.
This includes, without limitation, trading losses, investment losses, lost profits, lost opportunities, lost data, business interruption, inaccurate analytics, delayed alerts, unavailable data, model errors, software bugs, third-party failures, or reliance on platform content. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Deskscale Labs and its owners, directors, officers, employees, contractors, affiliates, partners, licensors, service providers, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your use of Deskscale, your violation of these Terms, your user content, your trading decisions, or your violation of applicable law.

We collect, use, and disclose personal information with your consent, unless otherwise permitted or required by law. Consent may be express or implied, depending on the nature of the information and the circumstances.
You may withdraw consent where permitted by law, but withdrawing consent may limit or prevent our ability to provide certain services. To withdraw consent, contact us at the address above.

We do not sell your personal information in the ordinary meaning of selling customer lists for money.
8. Service Providers
We may use third-party service providers to help operate Deskscale. Service providers may process personal information on our behalf. We require service providers to use personal information only for authorised purposes and to apply reasonable safeguards.
9. Cross-Border Processing

Retention periods may vary depending on the type of information and the reason it is collected. When information is no longer needed, we will delete, anonymise, or securely retain it as required or permitted by law.
11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, unauthorised access, disclosure, copying, use, or modification. However, no system is completely secure, and we cannot guarantee absolute security of personal information.
You are responsible for keeping your login credentials secure and notifying us of suspected unauthorised access.
12. Accessing or Correcting Your Information
You may request access to personal information we hold about you, subject to exceptions under applicable law. You may also request correction of inaccurate or incomplete personal information. To make a request, contact us at the address above. We may need to verify your identity before responding.
13. Account Deletion
You may request deletion of your account by contacting us. Some information may be retained where required or permitted by law, including for billing records, legal compliance, dispute resolution, fraud prevention, security, and legitimate business purposes.
14. Children and Minors
Deskscale is not intended for children or minors. We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child without appropriate consent, we will take reasonable steps to delete it.
15. Third-Party Links
Deskscale may contain links to third-party websites, tools, brokerages, exchanges, charting services, data providers, payment providers, or other services. We are not responsible for the privacy practices, security, or content of third-party services. You should review their privacy policies before using them.

Disclaimers & Risk Disclosures
- This is analysis and education only. Never investment advice, a recommendation, or an instruction to trade.
- Every decision is yours alone; we don't know your finances, risk tolerance, or goals.
- Trading risks real capital loss, including options, short-term, and 0DTE strategies.
- Past performance, backtests, and hypothetical results don't predict future outcomes.
- AI and model outputs can be wrong. Treat them as a research aid, not a final answer.
Please read this section carefully before using Deskscale, our website, dashboards, alerts, reports, analytics, market commentary, educational content, subscription products, or any related services.
By accessing or using Deskscale, you acknowledge and agree that you have read, understood, and accepted these disclaimers and disclosures.
1. Informational and Educational Use Only
Deskscale provides market analytics, market-structure observations, workflow tools, educational content, data summaries, watchlist-style information, and research-support materials only.
Deskscale does not provide: personalised investment advice; financial planning advice; trading advice; securities recommendations; investment recommendations; portfolio-management services; brokerage services; dealer services; order-routing services; execution services; automated trading services; fiduciary advice; tax advice; legal advice; or accounting advice.
Nothing on Deskscale should be understood as a recommendation, solicitation, instruction, or offer to buy, sell, hold, short, trade, hedge, or otherwise transact in any security, option, derivative, cryptocurrency, commodity, futures contract, exchange-traded fund, index product, or other financial instrument.
2. No Investment Advice or Trade Recommendations
Any market setups, alerts, dashboards, watchlists, analytics, rankings, labels, scores, regime classifications, sentiment indicators, flow indicators, probability-style language, technical levels, strategy labels, or educational examples shown by Deskscale are provided for informational and educational purposes only.
They are not trade recommendations, investment advice, instructions to enter, exit, size, manage, or avoid any trade, or guarantees that a market will move in any particular direction.
Deskscale may display terms such as "setup," "watch," "breakout," "breakdown," "risk-on," "risk-off," "bullish," "bearish," "momentum," "support," "resistance," "flow," "pressure," "confluence," "quality," "score," "edge," "priority read," "invalidation," or similar market-analysis language. These terms are analytical labels only. They do not convert the content into investment advice or a recommendation.
You must independently evaluate all information before making any financial decision.
3. You Are Solely Responsible for Your Decisions
All investment, trading, and financial decisions remain solely your responsibility. You are responsible for: determining whether any trade or investment is suitable for you; understanding the risks of the instruments you trade; deciding whether to enter, exit, hold, avoid, hedge, or size a position; managing your own risk and losses; using stop losses, position sizing, and other risk controls; consulting a qualified professional where appropriate; complying with all laws, rules, and regulations applicable to you; and ensuring that any decision fits your objectives, financial condition, risk tolerance, experience, and time horizon.
Deskscale does not know your financial situation, account size, trading experience, tax position, investment objectives, liquidity needs, risk tolerance, or personal circumstances. Therefore, Deskscale cannot determine whether any market idea, setup, analysis, or educational example is appropriate for you.
4. Market Risk and Loss of Capital
Trading and investing involve substantial risk. You may lose money. You may lose all of your capital. In some instruments, including leveraged products, options, futures, margin trading, short selling, and certain derivatives, you may lose more than your initial investment.
Markets can move quickly and unpredictably. Prices may gap, reverse, become illiquid, or move sharply due to news, earnings, economic data, market structure, volatility, liquidity changes, geopolitical events, regulatory actions, or other factors. You should not trade or invest money you cannot afford to lose.
5. Options, Short-Term Trading, and 0DTE Risk
Options trading is complex and carries a high level of risk. Short-dated options, including same-day expiry or 0DTE options, may experience rapid changes in value and may expire worthless.
Options risks include, but are not limited to: total premium loss; time decay; volatility crush; liquidity risk; assignment risk; execution risk; wide bid/ask spreads; slippage; early exercise; pin risk; gap risk; and rapid loss of capital.
Short-term trading, day trading, scalping, momentum trading, and event-driven trading can be especially risky. Frequent trading may increase commissions, fees, spreads, taxes, emotional decision-making, and the likelihood of loss. Any options-related examples or analytics provided by Deskscale are educational only and are not recommendations to trade options.
6. Past Performance Is Not Indicative of Future Results
Past market behaviour does not guarantee future results. Historical examples, prior setups, backtests, model outputs, screenshots, trade examples, case studies, chart examples, probability references, or performance-style analysis are not reliable indicators of future performance.
A setup that worked previously may fail in the future. A model that appeared useful in one market regime may stop working when volatility, liquidity, participation, trend, positioning, news flow, or macro conditions change.
7. Hypothetical, Simulated, and Backtested Results
Deskscale may display or discuss hypothetical, simulated, paper-traded, model-generated, or backtested information. Such information has important limitations. Hypothetical and backtested results do not represent actual trading. They may not account for real-world constraints such as: slippage; spreads; commissions; liquidity; rejected orders; delayed fills; partial fills; trading halts; data errors; emotional decision-making; position-sizing errors; tax impact; market-impact costs; borrow availability; margin requirements; execution delays; or changes in market conditions.
No representation is made that any user will achieve results similar to any hypothetical, simulated, paper, backtested, or example result shown on Deskscale.
8. No Guarantee of Accuracy, Completeness, or Timeliness
Deskscale may rely on market data, third-party data, user-provided information, public information, APIs, vendors, calculations, models, automated systems, and internal analytics. We strive to provide useful information, but we do not guarantee that any information is accurate, complete, current, uninterrupted, reliable, or error-free.
Information may be delayed, stale, incomplete, misclassified, unavailable, calculated incorrectly, affected by vendor outages, API limitations, exchange delays, software bugs, incorrect source data, market-data entitlements, or system downtime. You should independently verify all information before relying on it.
9. AI, Model, and Analytics Limitations
Deskscale may use algorithms, statistical methods, artificial intelligence, machine learning, rule-based systems, scoring models, ranking systems, classification systems, or automated analytics. These systems are limited. They may produce incorrect, incomplete, outdated, biased, inconsistent, or misleading outputs. They may fail to identify important market risks, overfit historical data, fail during unusual market conditions, interpret data incorrectly, or generate false positives and false negatives.
Any AI-generated or model-generated output should be treated as a research aid only. It should not replace your own judgment, due diligence, risk management, or consultation with qualified professionals.
10. Alerts and Notifications Are Not Instructions
Deskscale may provide alerts, notifications, watchlist updates, dashboard highlights, market-condition changes, or other time-sensitive information. These are not trading instructions.
An alert does not mean that you should enter a trade, that a trade is safe, that a setup is valid for your account, or that a market move will continue. An alert may arrive late, contain errors, or become invalid immediately after being generated. You are solely responsible for deciding whether, when, and how to act.
11. No Brokerage, Custody, or Execution
Deskscale is not a broker, dealer, exchange, clearing firm, custodian, investment platform, order-routing platform, or execution venue. Deskscale does not hold customer funds, custody assets, place trades, route orders, execute orders, clear transactions, or manage brokerage accounts. Any brokerage account, exchange account, trading platform, or financial account you use is separate from Deskscale and governed by that provider's own terms, risk disclosures, fees, and policies.
12. No Fiduciary Relationship
Your use of Deskscale does not create a fiduciary relationship, advisory relationship, client relationship, portfolio-management relationship, broker-client relationship, agency relationship, partnership, joint venture, or employment relationship between you and Deskscale Labs.
13. No Registration Representation
Unless expressly stated otherwise in writing, Deskscale Labs is not registered as an investment adviser, portfolio manager, investment dealer, exempt market dealer, broker-dealer, futures commission merchant, commodity trading adviser, or securities dealer in any jurisdiction.
If any registration, exemption, licence, or regulatory status becomes applicable to the business, Deskscale Labs will update its disclosures as required. Users are responsible for obtaining their own professional advice.
14. Third-Party Data, Links, and Services
Deskscale may display, reference, integrate with, link to, or rely on third-party websites, APIs, data vendors, platforms, tools, brokerages, charting providers, payment processors, analytics providers, or other services. We do not control third-party services and are not responsible for their content, accuracy, availability, security, privacy practices, pricing, fees, data rights, outages, or performance. Your use of third-party services is governed by their own terms and policies.
15. Conflicts of Interest
Deskscale Labs, its owners, operators, employees, contractors, affiliates, partners, or contributors may hold positions in securities, options, cryptocurrencies, or other instruments discussed, displayed, analysed, or referenced on the platform. These positions may be opened, closed, increased, reduced, or hedged at any time without notice.
Deskscale Labs may also receive subscription fees, affiliate compensation, referral fees, sponsorship revenue, advertising revenue, data-provider relationships, partnership compensation, or other commercial benefits. Where required, Deskscale Labs will disclose material relationships or compensation arrangements. You should assume that conflicts of interest may exist and should independently verify all information before making decisions.
16. Testimonials and Examples
Testimonials, reviews, case studies, screenshots, examples, or user stories may not represent typical results. They do not guarantee that you will have the same or similar experience. Trading outcomes vary widely based on market conditions, skill, experience, risk management, account size, timing, discipline, and many other factors.
17. No Warranty
Deskscale is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Deskscale Labs makes no warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of accuracy, reliability, completeness, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Deskscale Labs and its owners, directors, officers, employees, contractors, affiliates, partners, licensors, service providers, and agents will not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages, including but not limited to: trading losses; investment losses; lost profits; lost opportunities; loss of capital; loss of data; business interruption; system outages; inaccurate data; delayed alerts; model errors; software bugs; third-party service failures; unauthorised access; reliance on platform content; or decisions made using Deskscale.
This limitation applies whether the claim is based on contract, tort, negligence, strict liability, statute, equity, or any other legal theory, even if Deskscale Labs has been advised of the possibility of such damages. Nothing in this disclaimer limits liability that cannot be limited under applicable law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Deskscale Labs and its owners, directors, officers, employees, contractors, affiliates, partners, licensors, service providers, and agents from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from or related to: your use of Deskscale; your trading or investment decisions; your violation of these terms or disclosures; your violation of applicable law; your misuse of market data or third-party data; your user-generated content; or your infringement of any third-party rights.
20. Professional Advice
Before making financial, investment, trading, tax, legal, or accounting decisions, you should consult qualified professionals who understand your personal circumstances. Deskscale is not a substitute for professional advice.
21. Acceptance
By using Deskscale, you acknowledge that: you understand Deskscale is informational and educational only; you understand Deskscale does not provide investment advice or trade recommendations; you are solely responsible for your own decisions; you understand markets involve risk; you may lose money; you may lose all of your capital; you will independently verify information before relying on it; and you accept these disclaimers and risk disclosures.
